Welcome to Fresno Photo Booth Company. These terms govern your use of our website at fresnobooths.com and our photo booth rental services. By booking with us or using our site, you're agreeing to everything below, so please give it a read. Who We Are Fresno Photo Booth Company ("we," "us," "our") provides photo booth rentals, audio guestbook rentals, memory book services, and related event services in the Fresno, California area and surrounding regions. When we say "you" or "client," we mean the person booking our services. Booking & Payments When you fill out our booking form and sign the service contract, you're entering into an agreement with us for the services and date you selected. A non-refundable booking fee of $50 is required to secure your date. Your event will not be added to our calendar until that deposit is received and cleared. The remaining balance is due on or before the day of your event. We accept credit cards, Venmo, CashApp, Zelle, and PayPal. We do not accept personal checks. If you need extra time at your event beyond what was agreed to, additional hours can be added at $125 per hour and must be paid in cash or by credit card before the extra time begins. Date Changes & Cancellations Life happens, we get it. If you need to change your date, let us know in writing at least 14 days before your original event date. Changes depend on our availability and require a new service contract. If we're not available for the new date, the booking fee is forfeited and the event is cancelled. If you cancel less than 30 days before your event, all payments received are forfeited. If you cancel more than 30 days out, only the booking fee is forfeited. To make things easier, your $50 deposit can be applied to another event within one year (365 days). What We Need From You To make sure everything runs smoothly on your big day, we need a few things. The venue must be accessible for our team to deliver and set up at least 45 minutes to 1 hour before your event starts. Each photo booth requires a space of at least 10 feet by 10 feet with 10 feet of ceiling clearance, a standard 120V electrical outlet within 25 feet, and a clear path for delivery. No stairs, tight hallways, or obstacles that make setup impossible. Travel If your event is more than 20 miles from our office location (zip code 93273), a travel fee will apply. Outdoor Events We show up rain or shine, but outdoor events come with risks. If it rains, we will shut down to protect our equipment and there are no refunds for weather-related shutdowns. Heat above 105 degrees can cause electronics to overheat and temporarily shut off. Sun glare makes the screen hard to see and causes squinting in photos. Wind can send backdrops flying. And the booth must be set up on a hard, level surface. It won't work on grass, rocks, or sand unless you've prepared a dedicated flat area. Standby Time Performance delays due to introductions, toasts, speeches, or other event formalities count as part of your booked service time. We won't add extra time because of stoppages. The clock is running from your contracted start time. Our Equipment You're responsible for any damage to or loss of our equipment caused by misuse by you or your guests, or by theft. Our photo booth equipment represents thousands of dollars in investment and we trust you to help us keep it safe. Safety & Conduct We have a zero-tolerance policy for abusive behavior toward our team. This includes inappropriate touching, sexually suggestive comments or gestures, verbal abuse, threats, racist remarks, or any hostile actions. Our on-site staff will give one warning to the contract holder. If the behavior continues or cannot be resolved, we reserve the right to terminate the event immediately. No refund will be given for events terminated due to guest misconduct. Any incident of inappropriate physical contact may result in immediate termination without a warning. Children Under 12 Kids love our booths and we love that. However, we may enforce our policy requiring children under 12 to have an adult supervising nearby. The adult doesn't need to be inside the booth, just close enough to keep an eye on things. What Happens If Something Goes Wrong Technology isn't perfect. If we're unable to provide a working photo booth for at least 80% of your service period, you'll receive a prorated refund based on the amount of service you did receive. If our printer fails, we'll provide a website where your guests can download digital files and order prints for free with free shipping, or photos will be delivered via text or email. If no service is received due to circumstances outside our control, our maximum liability is a full refund of all payments received. We are not responsible for any consequential damages or lost opportunities. SMS Communications By opting in to text messages on our booking form, you agree to receive SMS messages from us about your booking status, event reminders, and promotional offers. You can opt out anytime by replying STOP. Message and data rates may apply. See our Privacy Policy at fresnobooths.com/privacy-policy for full details on how we handle your information. Intellectual Property All custom photo strip designs, templates, branding elements, and website content are the property of Fresno Photo Booth Company. Photos taken at your event are yours to keep and share, but we may use them for promotional purposes unless you tell us otherwise in writing. Venue Restrictions Sometimes the venue or ceremony officiant has rules we have to follow, things like where we can set up, noise levels, or timing. We'll do our best to work within those guidelines, but we can't be held responsible for limitations imposed by your venue. Disputes If there's ever a disagreement between us, we both agree to resolve it through arbitration before pursuing litigation. If it does go to court, this agreement is governed by the laws of the State of California and any proceedings will take place in Fresno County. The losing party is responsible for the winning party's reasonable attorney fees and all litigation costs. The Fine Print This agreement, combined with your signed service contract, represents the full agreement between you and Fresno Photo Booth Company. If any part of these terms is found to be unenforceable, the rest still stands. No changes to this agreement are valid unless made in writing and signed by both parties. Questions?
